These terms are between DialTale, LLC, a Virginia limited liability company, 1221 South Eads Street #1612, Arlington, VA 22202 (“DialTale”, “we”), and the person or business that signs up for the partner program (“you”). You agree to them when you tick the box on the sign-up form.
1. What you do
You promote a DialTale story to your audience using your code and the words on your promo sheet. Use those words as written unless we agree a change by email. We can update them by email, and you switch to the new words within 5 business days.
2. What we pay
We pay for qualified listeners in 30-day periods. Your first period starts the day you generate your code, and each new period starts when the last one ends. The rate depends on how many qualified listeners you send in that period, and the rate you reach applies to every qualified listener in it:
- 1 to 99 qualified listeners: $0.10 each
- 100 to 499 qualified listeners: $0.15 each
- 500 or more qualified listeners: $0.20 each
We pay at most $250 for any one period. You pay us nothing, for anything. We don’t promise any number of listeners or any amount of earnings.
3. Who counts as a qualified listener
A caller counts when all of these are true:
- they enter your code on a call to that story’s line while your code is on;
- that number has never called a DialTale line before, and wasn’t already signed up for anything from DialTale before that call;
- their carrier verifies the number;
- they hear at least 60 seconds of the story on that one call. Hooks, intros, notices and sponsor messages don’t count toward the 60 seconds.
Each listener counts once, ever, across all partners. Our call records decide the count. Calls we can’t verify aren’t paid.
4. Your code
Your code is yours alone and we never give it to anyone else. If no one uses it for 90 days, it switches off. You can switch it back on from your dashboard, and it keeps counting from then on. Callers who use it while it’s off aren’t counted.
5. Reports and payment
Your dashboard shows totals: qualified listeners and pay for each period. You don’t get callers’ numbers or any detail about a caller. We pay what you earned in a period within 7 days after it ends. If what we owe you is under $10, it carries over until it reaches $10. We review each period’s calls before paying, and we may ask for your payment details and a Form W-9 before paying you.
6. Rules for your promotion
- If you give an opinion of the story, it must be your honest opinion, and you must have heard it.
- Say the required line on your promo sheet every time it applies, and make clear it’s a paid partnership.
- Don’t promote the story by text message, robocall, cold call or spam.
- Don’t pay or reward anyone to call, and don’t call to run up the count, yourself or through staff, family or software.
- Don’t promote the story on any show, or at any place or event, aimed at children under 13.
- Follow the laws that apply to your advertising.
- Send us a recording, link or photo of a use when we ask.
If you break this section we can switch off your code at once, and we don’t pay for listeners that came from the breach.
7. Radio stations only
You hold the FCC license for the station or are authorized to act for the licensee. The station makes any sponsorship announcement required by 47 U.S.C. 317 and 47 C.F.R. 73.1212. We pay the station only, and pay no host or employee personally. Anyone at the station who is paid or promised anything for this promotion by someone else tells the station before it airs (47 U.S.C. 508).
8. Names and materials
You may use the DialTale name, the story’s title and poster, and your QR code only to promote the story under these terms, and only while you’re a partner. Take down signs and stop reading the promotion within 7 days after you stop being one. We own our stories and materials. You own your show, channel, station or venue name, and we may use it on your page.
9. Ending
Either of us can end this at any time by email to contact@dialtale.fm. We pay what you earned up to that day, except as section 6 says. We can change these terms by posting a new version here and emailing you; the new terms apply from the next period. If we pause or change the story or the line, we’ll tell you by email.
10. General
You are an independent business, not our employee or agent, and you handle your own taxes. The program is open to partners in the United States. These terms are the whole agreement, and changes must be in writing, including email. Virginia law governs them.
